Terms of Use

Last updated:

These terms govern use of the AILA app and of this website (getaila.de) in relation to the provider. They are a translation of the German terms for easier reading. The provider is the sole proprietor named in the legal notice (Impressum). The name and the postal address are stated there and are not repeated here.

Contact: support@getaila.de

1. Scope

AILA is a learning app about artificial intelligence: a guided path, articles, quizzes, and a daily briefing. Part of the app can be used free of charge, as the app itself shows. AILA Pro unlocks the further lessons and features described in the app as part of the subscription.

These terms apply to use of the app and of this website. The purchase of AILA Pro is separate. That contract is made with Apple, not on this website and not with the provider. Conflicting terms of the user do not apply.

2. Apple’s Standard EULA

Download and use of the iOS app are also subject to Apple’s Licensed Application End User License Agreement (Standard EULA): apple.com/legal/internet-services/itunes/dev/stdeula. The provider has not put a custom EULA in its place.

Between the user and Apple, Apple’s terms apply. Between the user and the provider, these terms apply. Where the Standard EULA limits liability in a way German law does not allow, in particular for intent, gross negligence, injury to life, body or health, the German Product Liability Act (Produkthaftungsgesetz), or an assumed guarantee, the liability section below prevails between the user and the provider.

3. AILA Pro, billing, cancellation, and withdrawal

AILA Pro is an auto-renewing subscription, monthly or yearly, with a seven-day trial where Apple offers it. Before the purchase, Apple shows the name, the length, the price, what is included, and that the subscription renews.

Apple sells and bills AILA Pro. In the European Union that is usually Apple Distribution International Ltd., as commission agent or seller. Payment, the trial, and renewal run through In-App Purchase. The provider does not take payment on this website and does not itself charge a fee.

The subscription renews for the same length (a month or a year) unless it is cancelled in the Apple ID subscription settings at least 24 hours before the end of the current period. Where Apple offers the seven-day trial, the trial converts to the paid plan unless it is cancelled before it ends. The provider cannot cancel an Apple subscription on the user’s behalf.

Cancellation and refunds are handled only by Apple, under Apple’s terms. The route is the one Apple provides, including the Apple ID subscription settings and reportaproblem.apple.com. The provider does not refund an amount Apple has charged. The purchase terms Apple displays apply, including the Apple Media Services Terms for a German Apple ID, or the version Apple shows for the country of the Apple ID.

For consumers in the European Union, Apple provides the information on the right of withdrawal in the purchase flow. The statutory period is 14 days. For digital content it ends early where the statute so provides, in particular where the user has expressly agreed that performance starts before the end of the period and has acknowledged that the right of withdrawal is then lost. Apple collects that consent in its checkout. Section 356(5) of the German Civil Code (BGB) is the relevant German rule. This website does not conclude the subscription and does not offer a separate withdrawal button. The provider does not process a withdrawal that belongs to the contract with Apple.

If the app is later offered on Google Play, Google would sell and bill that listing under Google’s terms. The same split would apply: the store bills, and the provider does not.

4. Availability

The provider does not guarantee uninterrupted availability of the app, this website, or the content, and does not guarantee error-free operation. Maintenance, faults, updates, and dependence on Apple, GitHub, and other services can interrupt use. Crashes, outages, and loss of data stored only on the device give rise to no claim beyond the statutory minimum. The liability section governs where a claim is not allowed to be excluded. Nothing in this section waives liability for intent, gross negligence, injury to life, body or health, the Product Liability Act, or an assumed guarantee.

5. Content, AI, and no professional advice

The content is for learning and general orientation. It is compiled with care. Parts of it, in particular the daily briefing and longer articles, are generated or assisted by AI and then edited and assembled. There is no warranty, and no liability beyond the liability section, for accuracy, completeness, or currency.

Claims and figures that come from a vendor or another source are that party’s claims. They are not promises by the provider. The provider does not adopt them as its own.

The content is not legal, tax, financial, or other professional advice. Decisions, including business and financial ones, are the user’s own.

6. Links

The app and this website link to third-party sites, including sources for a briefing item and the stores. The operators of those sites are responsible for their content. The provider does not adopt that content. Links are not checked continuously. When the provider learns of a clear infringement, the link will be removed where that is reasonable. Liability for the provider’s own content follows the liability section and the general law.

7. User obligations

Use of AILA must be lawful. In particular, the user must not:

8. Changes to content, features, and these terms

The provider may change content and features, including to correct errors, retire an outdated piece, or follow the subject matter. There is no claim that a particular article or quiz remains available. What AILA Pro includes is what the app describes at the time. Rights that mandatory consumer law, or the contract with Apple, confers are unaffected.

The provider may change these terms for the future. The current version is this page. For a purchase, the terms Apple showed at checkout govern that purchase. Mandatory consumer protections remain in force.

9. Liability

The provider’s liability, in contract and otherwise, on any legal ground, is as follows.

  1. Liability is unlimited for intent and gross negligence, for injury to life, body, or health, under the German Product Liability Act (Produkthaftungsgesetz), and where a guarantee has been assumed.
  2. For a slightly negligent breach of an essential contractual duty, liability is limited to the foreseeable damage typical for this kind of contract. Essential contractual duties are duties whose performance makes the proper performance of the contract possible in the first place, and on which the user ordinarily relies.
  3. Any other liability is excluded, including for slight negligence outside essential duties.
  4. These rules also apply in favour of the provider’s legal representatives and vicarious agents.
  5. Mandatory consumer law remains in force. Where Apple is the seller of the subscription, statutory rights in the digital product are directed first to Apple.

10. Governing law

The law of the Federal Republic of Germany applies, excluding the UN Convention on Contracts for the International Sale of Goods. Mandatory consumer-protection rules of the country in which a consumer has their habitual residence remain in force, including a place of jurisdiction that statute reserves to consumers. The contract with Apple follows Apple’s terms.

11. Severability

If a provision is or becomes invalid, the remainder stays in effect. The invalid provision is replaced by the statutory rule.
